Arizona Revised Statutes Section 11-1133.A prohibits Arizona County Recorders from recording a deed unless the deed is accompanied by a document that satisfies the 11 requirements of the statute. Our form Special Warranty Deed contains language that causes the deed to be exempt from the requirements of Section 11-1133.A and recorded without preparing the document otherwise required by that statute.
Warning: To convey clear title the owner of the real estate must have his or her spouse sign a Disclaimer Deed and record the Disclaimer Deed with the Special Warranty Deed. The Disclaimer Deed is the non-owner spouse’s acknowledgement that the non-owner spouse does not have any ownership interest in the real property.
Note: The deed must be signed in front of a notary public and notarized then recorded with the County Recorder of the Arizona county in which the real property is located.
