When signed by a spouse who is an Arizona resident this document causes the other spouse to become the owner of an Arizona LLC as separate property rather than community property.  Warning:  Arizona law provides that if one spouse of an Arizona married couple acquires an interest in an LLC both spouses automatically own a community property interest in the LLC whether or not both spouses are named in the Articles of Organization or the Operating Agreement.

Description

An Arizona resident who acquires an ownership interest in an Arizona LLC while married will automatically own it as community property with his or her spouse unless the LLC interest was acquired as a gift or inheritance or the non-owner spouse signs a disclaimer in which he or she acknowledges that the owner spouse owns the LLC interest as his or her separate property.

This Disclaimer of a Membership Interest in an Arizona LLC form when completed, signed by the non-owner spouse and notarized will have the following legal consequences:

  1. The owner spouse will own 100% of the LLC membership interest as his or her sole and separate property.
  2. The non-owner spouse will own none of the LLC membership interest.
